The legal reason we ask for the number of guests is in case of emergency. If you have listed only 2 guests in your room, but you have 6 with you, and a fire breaks out... We, and the fire department will only be looking for two people.

Food costs (even coffee) must be covered byt the rates, or the company will lose money. When that happens, the hotel will either raise the rates, or discontinue amenities. I know someone who brought 9 people to a 6 person room. The resort's official policy is that extra guests will be housed in another room at the going rate, When the front desk called to see how many were actually in the room, rather than split them, they charged them $25.00 extra per person over the room limit.

As long as you tell the hotel what the set up is there shouldn't be a problem. Getting caught sneeking in a 3rd adult is not a good thing and hotel staff see WAY more than you think they do. This I know for a fact from working in a BIG hotel for 8 years. The little, cheaper hotels might not care how many people you have. The bigger hotels do care.
